On October 22, 2011 a special meeting was held as a result of a homeowner complaint to the Attorney General's office. The AG's office found the association in violation of the Open Meetings Act (sunshine law) because a detailed agenda was sent to the membership less than 24 hours prior to the annual meeting of July 17, 2010. Consequently it was necessary to hold a publicly noticed meeting to discuss and re-vote on the issues decided in that meeting. Two guest speakers presented at the meeting. Mr. Rob Pine of the NM Enviroment Department, Drinking Water Divsion spoke on what it means to remain a public mutual domestic water association and answered a number of member questions. Following Mr. Pines presentation, Mr. Tom Martin, legal counsel for the association spoke and explained the differences between a mutual domestic and becoming a non-profit private corporation. He also addressed members questions and concerns. Following this a vote was taken on the two issues decided in the earily meeting to ratify or rescind the vote previously taken. The membership voted in favor of ratifying their prior vote to become a private non-profit corporation and additionally ratified the vote for directors previously taken. Work is now continuing to change from a public mutual domestic to a private non-profit corporation. The membership recently received a draft copy of the proposed Articles of Incorporation and By-Laws. For more information regarding this meeting please refer to the minutes.
